Refund Policy

Effective Date: September 6, 2026

This Refund Policy explains the general refund and cancellation principles applicable to services, deposits, materials, fabrication work, and other paid services provided by Empire Welding & Construction LLC (“Empire Welding & Construction,” “Company,” “we,” “us,” or “our”).

Because construction and fabrication projects are often customized and may involve labor, materials, scheduling, engineering coordination, transportation, fabrication, and other project-specific costs, refund eligibility may vary depending on the applicable project agreement.

1. General Policy

Refunds are governed by the applicable written proposal, contract, purchase order, invoice, or other project agreement. Where a specific agreement contains refund, cancellation, deposit, or payment terms, those terms will control to the extent permitted by law.

2. Quote Requests

Submitting a quote request through the Website does not require payment and does not create a right to a refund.

3. Deposits

Deposits may be required before fabrication, material procurement, scheduling, mobilization, or other project activities begin. Deposits may be non-refundable to the extent permitted by the applicable agreement and law when they cover materials ordered, labor performed, fabrication begun, project scheduling, subcontractor commitments, transportation arrangements, engineering or design coordination, or other project-specific expenses.

4. Custom Fabrication

Custom-fabricated products and components may be manufactured specifically for a customer and may therefore be subject to limited refund or cancellation rights after fabrication begins.

5. Materials

Materials ordered specifically for a project may be non-refundable if the supplier does not permit cancellation or return or if the applicable project agreement makes the material commitment non-refundable.

6. Cancellation Before Work Begins

If a customer requests cancellation before material procurement or substantial work begins, the Company may review whether a refund is appropriate after considering amounts already paid, costs incurred, materials ordered, labor performed, scheduling commitments, and third-party expenses.

7. Cancellation After Work Begins

Once fabrication, construction, installation, procurement, or other substantial project work has begun, amounts relating to work performed and costs incurred are generally not refundable unless otherwise required by law or the applicable agreement.

8. Change Orders

Customer-requested changes may affect price, schedule, materials, labor, fabrication, delivery, and installation. Additional charges may apply.

9. Project Delays

Construction schedules may be affected by weather, material availability, site conditions, inspections, permits, engineering, customer delays, subcontractors, transportation, governmental requirements, and circumstances outside the Company's reasonable control. Project delays do not automatically create a right to a refund.

10. Customer-Provided Information

Customers are responsible for providing accurate information regarding dimensions, site conditions, access, property boundaries, project requirements, drawings, and specifications. Additional costs caused by inaccurate or incomplete information may apply as provided by the applicable agreement.

11. Defective or Damaged Materials

If a material or product is believed to be defective or damaged, the customer should notify the Company promptly. The Company may investigate the issue and determine an appropriate remedy under the applicable agreement, manufacturer warranty, supplier policy, or applicable law.

12. Workmanship Concerns

Customers who believe there is a workmanship issue should contact the Company promptly so the issue can be evaluated. A workmanship concern does not automatically create a right to a cash refund. Where appropriate, the Company may inspect and determine whether corrective work is required under the applicable agreement.

13. Third-Party Costs

Third-party costs may include engineering, permitting, inspection, material suppliers, transportation, equipment rental, subcontractors, and specialized services. These costs may be non-refundable depending on the applicable agreement.

14. Requesting a Refund

Refund requests should be submitted in writing to: support@empireweldingandconstruction.com

Include: customer name, company name, project name or description, invoice or proposal number if available, payment date, amount paid, reason for the request, and relevant supporting information.

15. Refund Review

Refund requests may be reviewed based on the applicable written agreement, work already performed, materials purchased, cancellation timing, third-party costs, project status, and applicable law.

16. Approved Refunds

If a refund is approved, it will generally be issued using the original payment method when reasonably possible. Processing time may depend on the payment processor or financial institution.

17. Legally Required Refunds

Nothing in this Refund Policy is intended to waive or limit rights or remedies that cannot legally be waived under applicable law.

18. Changes to This Policy

We may update this Refund Policy from time to time. Changes will be posted on this page with an updated effective date.
